Terms of Service

These Terms of Service ("Terms") govern your use of the BrandCheckr website and service located at brandcheckr.com ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

BrandCheckr is a brand name availability checking tool that:

  • Checks whether a given brand name is available as a domain across .com, .io, .co, and .ai extensions
  • Checks whether a given handle is available on Instagram, Twitter/X, LinkedIn, and YouTube
  • Generates AI-powered alternative brand name suggestions for paid users

2. Free and Paid Plans

  • Free Plan: You may perform up to 3 brand name availability checks per day at no cost. This limit resets daily.
  • Starter Plan ($9.99): A one-time payment that unlocks 10 AI-generated alternative brand name suggestions for one specific brand name search. Each suggestion includes availability checks on .com, .ai, Instagram, and Twitter/X.
  • Pro Plan ($19.99): A one-time payment that unlocks 25 AI-generated alternative brand name suggestions for one specific brand name search, with the same availability checks as the Starter plan.

All paid plans are one-time purchases. There are no recurring charges, subscriptions, or hidden fees.

3. Accuracy and Limitations

We strive for accuracy using authoritative RDAP servers and DNS verification, but please understand:

  • No guarantee of availability. Domain and social media availability can change at any time. A name that appears available when checked may be registered by someone else before you act on it.
  • Not legal advice. BrandCheckr checks technical availability (domain registration, social handle existence). We do not check trademarks, business name registrations, or provide legal guidance. Consult a trademark attorney before committing to a brand name.
  • Third-party data. Our results depend on external services (RDAP servers, DNS resolvers, social media platforms). Temporary outages or changes in these services may affect accuracy.
  • Social media checks are approximate. Social platforms may block, rate-limit, or change their URL patterns. A "available" result means we received a 404 response; a "taken" result means we received a 200 response. Edge cases may exist.

4. Payments and Refunds

  • All payments are processed securely through Stripe. We do not store your credit card information.
  • Prices are listed in United States Dollars (USD) and are exclusive of applicable taxes. Tax (e.g., 18% GST for customers in India) will be calculated and added automatically at checkout based on your billing location.
  • Because paid plans deliver digital content instantly (name suggestions are generated and shown immediately after payment), all sales are final. We do not offer refunds for paid plans.
  • If you experience a technical issue that prevents you from receiving your suggestions after payment, contact us at support@brandcheckr.com and we will resolve the issue or provide a refund at our discretion.

5. Acceptable Use

You agree not to:

  • Use automated scripts, bots, or scrapers to access the Service
  • Attempt to bypass rate limits, usage restrictions, or payment requirements
  • Use the Service to engage in domain squatting, cybersquatting, or any form of trademark infringement
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service in any way that violates applicable laws or regulations

We reserve the right to suspend or terminate access for any user who violates these terms.

6. Intellectual Property

  • The BrandCheckr name, logo, website design, and underlying code are the intellectual property of BrandCheckr.
  • Brand name suggestions generated by the Service are provided for your use. We do not claim ownership of names you discover or register based on our suggestions.
  • We make no representation that suggested names are free from trademark claims by third parties.

7. Limitation of Liability

To the maximum extent permitted by law, BrandCheckr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages from reliance on availability results, loss of business opportunity, or inability to register a domain or social media handle. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that availability results will be 100% accurate.

9. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.
